The meltdown of the U.S. financial markets in 2007-2008 effectively wiped out conventional chattel financing of manufactured homes (MHs) in land lease communities. The S.A.F.E. and Dodd-Frank Acts of 2008 prohibit seller financing of MHs without Mortgage Loan Originator (MLO) and Mortgage Broker (MB) licenses, and all associated disclosures. Lease-with-Option-to-Purchase (L-O) is an acceptable alternative in many states for community owners (COs) to sell MHs.
Spencer will review his firm’s use of L-O over the past 25+ years to sell new and used MHs in his four communities in Ga. and Tx. As such, he will relay information from attorneys and regulators regarding the legal basis for L-O transactions, review examples of the structure of a L-O transaction, provide sources of information and copies of contracts, discuss pre-qualification of applicants and underwriting, review default rates, compare new vs. used MH sales and less expensive vs. more expensive MH sales, review common misunderstandings about L-O transactions, and discuss how COs might use L-O transactions in conjunction with conventional chattel financing.
